1. Definitions

    •    “Company” refers to ET Build LTD, its employees, and subcontractors.

    •    “Client” refers to the individual, company, or entity commissioning the works.

    •    “Works” refers to the building, construction, and associated services carried out by ET Build LTD.

2. Quotations & Pricing

    •    All quotations are valid for 30 days unless otherwise stated.

    •    Prices are based on the information provided. Any changes to the scope of work or unforeseen circumstances may result in additional charges.

    •    All prices are subject to VAT at the prevailing rate.

3. Payments

Payments will be made according to the following structure unless otherwise agreed in writing:

    •    35% Deposit – Due upon acceptance of the quotation to confirm the booking and cover initial material costs.

    •    55% Interim Payment – Payable midway through the project or upon reaching agreed milestones.

    •    7% Practical Completion Payment – Payable once the main works are completed and ready for Client inspection.

    •    3% Final Retention Payment – Payable upon final sign-off, no later than 14 days after completion.

Additional Payment Terms:

    •    All materials remain the property of ET Build LTD until full payment is received.

    •    Late payments may incur interest at 5% per month.

4. Scope of Work

    •    The Company will carry out the works as detailed in the agreed quotation or contract.

    •    Any additional work requested by the Client must be confirmed in writing and may be subject to additional costs.

5. Client Responsibilities

    •    The Client is responsible for providing clear access to the site and a safe working environment.

    •    The Client must supply water, power, and toilet facilities as required.

    •    The Client is responsible for obtaining all necessary permissions, permits, and approvals unless otherwise agreed in writing.

    •    The Client must inform ET Build LTD of any known site hazards (such as asbestos or structural issues) prior to commencement.

6. Delays & Cancellations

    •    ET Build LTD is not liable for delays caused by factors beyond its control, including but not limited to adverse weather, material shortages, or unforeseen site conditions.

    •    If the Client cancels the project after works have started, the Client is liable for all completed works and materials purchased.

    •    ET Build LTD reserves the right to suspend or cancel work if payment terms are not met or health and safety are compromised.

7. Warranty

    •    ET Build LTD provides a workmanship warranty of up to 2 years, depending on the nature of the work completed. The specific warranty period will be confirmed in writing for each project.

    •    The warranty covers workmanship defects only. It does not cover misuse, third-party work, lack of maintenance, or materials supplied by the Client.

    •    Manufacturer warranties apply separately to materials supplied by ET Build LTD.

8. Liability

    •    ET Build LTD carries public liability insurance.

    •    The Company is not liable for hidden or unmarked services unless clearly identified by the Client in advance.

    •    The Company is not responsible for indirect or consequential losses, including loss of income, profit, or enjoyment.

9. Disputes

    •    Any disputes must be raised in writing within 7 days of discovering the issue.

    •    Both parties agree to resolve disputes amicably before taking legal action.

10. Governing Law

    •    These Terms & Conditions are governed by the laws of England and Wales.

By accepting a quotation or instructing ET Build LTD to commence work, the Client agrees to these Terms & Conditions.
